Denver Drunk Driving Attorney

Drunk driving is against the law in Colorado (and in every U.S. state). Decades of anti-drinking-and-driving campaigns have made this clear to most motorists. Despite that – and despite the fact that drunk driving comes with harsh, costly and lasting penalties, too many motorists still make the dangerous choice to get behind the wheel when they are impaired.

When they do and they cause crashes, they can be liable for compensating accident victims for their suffering and losses.

For more than a decade, the Denver car accident lawyers at Burnham Injury Law have been helping drunk driving accident victims fight for the compensation and justice they deserve. Experienced and tenacious, our attorneys are ready to provide you with effective, aggressive advocacy while helping you maximize your financial recovery.

Impaired & Drunk Driving Defined: The Legal Limits

Colorado law establishes specific legal limits for different types of drivers, based on age and the type of license a motorist holds. These legal limits include:

  • 08 for motorists who have standard (noncommercial) driver’s licenses and who are at least 21 years old
  • 0 for motorists who are younger than 21 (i.e., minors)
  • 04 for motorists who have a commercial driver’s license (CDL) – Please note that this limit can apply to CDL holders regardless of whether they are on-duty or driving a commercial vehicle.

For marijuana, Colorado has set the legal limit at 5 nanograms of THC (tetrahydrocannabinol) per milliliter of blood.1 While there are currently no laws regarding legal limits for other drugs, driving under the influence of any drug that impairs the ability to safely operate a vehicle (and properly respond to the driving environment):

  • Can cause crashes, for which the impaired driver can still be liable
  • Can result in criminal DUI charges.

This includes illicit drugs, as well as prescription and over-the-counter medications.

Justice for Drunk Driving Accident Victims: How a Lawyer Can Help

Immediately after an auto wreck, it can be challenging to know whether another driver may have been drunk or under the influence of drugs. This is especially true if any of the involved drivers has sustained moderate to severe injuries, like a traumatic brain injury, which can cause slurred speech and other symptoms that may be similar to alcohol or drug impairment.

In these situations, the counsel and support of a Denver car accident lawyer at Burnham Injury Law can be invaluable. Our attorneys can help the victims of drunk driving wrecks in various ways, including (but limited to) by:

  • Visiting the accident scene to gather more evidence (like additional accident scene photos)
  • Obtaining surveillance footage from police (and/or other) cameras
  • Analyzing the police report for statements regarding the appearance, actions and/or statements of the other involved motorist(s)
  • Retesting blood samples to verify BAC test results
  • Helping victims pursue their best options for compensation and justice.

When successful, drunk and impaired driving claims can result in damages for (but not necessarily restricted to):

  • Past and future medical care
  • Past and future lost earnings
  • Disability and/or disfigurement
  • Property damage
  • Loss of consortium
  • Pain and suffering.

While compensation from these cases can never change the past, it can provide victims with the financial support needed to seek treatment and concentrate on rebuilding their life.
