Impaired & Drunk Driving Defined: The Legal Limits

Colorado law establishes specific legal limits for different types of drivers, based on age and the type of license a motorist holds. These legal limits include:

  • 08 for motorists who have standard (noncommercial) driver’s licenses and who are at least 21 years old
  • 0 for motorists who are younger than 21 (i.e., minors)
  • 04 for motorists who have a commercial driver’s license (CDL) – Please note that this limit can apply to CDL holders regardless of whether they are on-duty or driving a commercial vehicle.

For marijuana, Colorado has set the legal limit at 5 nanograms of THC (tetrahydrocannabinol) per milliliter of blood.1 While there are currently no laws regarding legal limits for other drugs, driving under the influence of any drug that impairs the ability to safely operate a vehicle (and properly respond to the driving environment):

  • Can cause crashes, for which the impaired driver can still be liable
  • Can result in criminal DUI charges.

This includes illicit drugs, as well as prescription and over-the-counter medications.
